One facility that wholly failed to provide proper care and support for their residents is Avamere, located in Multnomah County, Oregon. Avamere is an elder care company that specializes in patients with dementia and Alzheimer’s. When eighty-six year old Elvera Stephan started exhibiting signs of dementia, her family moved her to Avamere in 2006. Less than two weeks later, Avamere called 911 for assistance after Elvera became confused and accused an employee of taking her car keys. When police arrived, they found Elvera on the ground handcuffed, and being restrained. Paramedics arrived and noted bruising on Elvera’s forehead, wrists, and knee. Avamere was fined $300 by the Department of Human Services for failing to appropriately intervene.

Elvera later died. Her family then sued Avamere for punitive damages, medical expenses, pain and suffering, and for Elvera’s loss of dignity. The court agreed that Avamere’s conduct was in breach of its duty of care to Elvera, and a jury awarded her family $904,200 in money damages.
