Family Seeks Over $1 Million In Personal Injury Damages In Wrongful Death Lawsuit Against Nursing Home.

Society tends to regard nursing homes as a safe haven for the elderly. The reality, however, indicates a too frequent pattern of abuse that targets the most vulnerable members of our community. Whether it is negligent treatment or overt abuse, nursing home abuse is a serious and widespread issue, and many families are adversely affected by it each year. In such situations, it would be wise to contact an expert nursing home abuse attorney at 617-787-3700.

A lawsuit has been filed following the death of an 86 year-old woman who lived at the Avamere Court at Keizer, a nursing home facility located in Oregon. According to the lawsuit, the woman, an 86-year-old resident at the long-term care home, had a fractured hip and a history of falling. Her plan of care required at least one person to help her out of bed and to use the restroom.

According to the complaint, the nursing staff repeatedly failed to respond to the needs of the woman, including helping her out of her bed so she could use the bathroom. As a result, she was often forced to walk to the bathroom herself, something her physician warned was extremely unsafe in her condition. The complaint claims that this negligent behavior by the nursing staff culminated in serious injury on December 24, 2015, when the woman slipped and fell while trying to get herself out of bed. She struck her head on the ground, and died later that night in the hospital. A lawsuit was subsequently filed, seeking $1.27 in damages from the home. The family is represented by Travis Prestwich, who operates his law practice out of Salem, Oregon.

Reports Indicate That Nursing Homes Have Practice Of Transferring Their Titles In Wake Of Abuse Allegations Instead Of Solving Actual Problems.

There has been much done in recent years to combat verbal and physical abuse and expose those who engage in such activities. These efforts have focused on both our nation’s schools, where the dangers of bullying have become more apparent, and in adult settings such as the workplace or in marital scenarios. What generally gets neglected is the extent to which the elderly share in suffering from these types of abuses, particularly in nursing homes. Nursing home abuse has been found to be widespread. In such a situation, it may be wise to contact an expert nursing home abuse lawyer at 617-787-3700.

According to a study done at Harvard University, nursing homes, when faced with allegations of abuse, neglect, or serious complaints against the staff, simply transfer the title of the nursing home to another company in order to rebrand themselves. The authors of the study found a “direct link between the number of times a facility had changed hands and the number of state violations it had.”

While changing things up in the wake of an abuse scandal might seem like a step forward, the study concluded that these changes were little more than a show for potential clients. In fact, ownership of the facilities was sometimes being transferred to those with even less experience running a nursing home facility, which in turn can lead to even more problems. In lieu of this title transfer, nursing homes with a history of abuse need to focus on better hiring practices and more effective employee training.

If you or a loved one has suffered abuse at the hands of a nursing home staff member, you may be entitled to significant monetary relief. Woman Accused Of Defrauding Her Own Mother Forced To Pay Damages In Elder Abuse Case.

The elderly represent one of the most vulnerable demographics in the world. Unfortunately, people are well aware of this, and too often try to take advantage of the elderly in many different contexts. There are often stories about those who convince older people to write them checks for various reasons, capitalizing on perceived confusion and loneliness. More sinister examples of elder abuse occur in nursing homes, where elder neglect and abuse by nursing home staff or by other residents occurs often. In such a situation, it would be wise to contact an expert nursing home abuse lawyer at 617-787-3700.

In a particularly reprehensible incident out of Massachusetts, Jane Hall, who lives in Hanson, MA, was reportedly found to have embezzled over $80,000 from her own mother, a resident of Taunton. A Taunton District Court has ordered the woman to pay $50,000 in damages.

The ruling came after Judge Michael Brennan imposed the “un-agreed” plea bargain sentence, in which both the defense and the prosecution suggest a sentence, and the judge determines which is more appropriate. Jane Hall was given a 3 year continuation without a finding of guilt, although the Commonwealth of Massachusetts requested a guilty finding along with the $50,000 payments in restitution.
