Nursing homes are entrusted with our relatives who can no longer care for themselves, often at great personal expense.  Unfortunately, this trust is too frequently violated as the elderly inhabitants of a nursing home may become targets of abuse, neglect and theft.  The sad reality is that this mistreatment goes mostly unreported and unnoticed, which is why it is crucial that family members maintain a vigilant eye for signs of a problem when visiting loved ones.

After getting reports about multiple concerns and instances of abuse, state officials did a surprise visit to a Victoria Falls Assisted Living facility in Andover, Kansas.   Their investigation revealed a substandard neglect of care and evidence that “staff members committed acts of abuse and neglect.” Officials were only able to interview 27 of the 63 residents there, four of whom provided evidence of abuse.  One resident interviewed allegedly was repeatedly abused, both verbally and physically, by at least four staff members.

After their investigation, state agents released a 150 page report listing all of Victoria Fall’s violations and a proposed plan to fix the problems.  The CEO at Victoria Falls has said they are taking appropriate measures to ensure the safety of their residents, most likely resulting in the termination of several staff members.  Victoria Falls was fined $8,000 a day between March and April for their violations, totaling $155,800.

If it wasn’t for the surprise visit by state officials, most of this abuse at a Kansas nursing home would most likely not have been reported.  It shows the importance of diligence and communication between family members and their loved ones in a nursing home. If you or a family member have been a victim of nursing home abuse, you may be entitled to substantial compensation for your physical injuries, as well as any emotional trauma and financial hardship caused by the accident.  Call us 24/7 at 617-787-3700,  or email us at info@gilhoylaw.com for your free and private consultation.  Your needs are our top priority!
