Nursing Home Faces Lawsuit After Death Of 99-Year Old Resident.

Sometimes, families are forced to make difficult decisions regarding the care of elderly parents or grandparents. A number of factors go into these decisions. But at the end of the day, what is most important is that they receive proper care and attention for their fragile conditions. As a result, many older people are sent to nursing homes, where their families hope they can rest assured that they are getting the best possible care from a diligent staff. Unfortunately, there are many well-documented instances of nursing homes failing to provide adequate care for their residents, and in some cases, the staff engaged in explicit abuse. In such a situation, it may be wise to contact an expert nursing home abuse attorney at 617-787-3700.

When the family of 99-year old Esbert James Pickering sent him to a nursing home in Portland, Oregon, they likely thought they were making the best and safest decision for someone they loved. However, two days after arriving at Avamere Rehabilitation, Mr. Pickering fell from his bed and broke his hip. He died a month later. A lawsuit initiated by Mr. Pickering’s family asserts that the nursing home was fully aware of Mr. Pickering’s tendency to fall out of his bed, yet failed to take any precautions that might have prevented such an occurrence. They further claim a direct connection between Mr. Pickering’s broken hip and his death one month later. Teresa Sanchez is the personal representative of the estate.

The lawsuit, which seeks $2.3 million dollars, claims that the nursing home should have given Mr. Pickering additional monitoring, and should have placed mats on either side of his bed with sensors that might have alerted nurses about a potential fall. The attorney for Avamere Rehabilitation has declined to comment on the pending litigation.
