According to her complaint, Geraldine Burris was a resident of the Sweetbriar Assisted Living facility in West Virginia from October 2011 until December 2013.  During her stay, Ms. Burris sustained multiple injuries from various falls. She suffered fractures, pressure sores and urinary tract infections. Her many injuries ultimately contributed to her demise.

Donna Burris Brown has filed her mother’s wrongful death lawsuit in the Kanawha County, West Virginia Circuit Court. Ms. Brown has filed the lawsuit individually and on behalf of her mother’s estate. The lawsuit lists Sweetbriar Assisted Living; Rhonda McDonald and Donna Gibeaut, administrators of Sweetbriar; John Does one through ten; and unidentified entities one through ten as defendants.

The lawsuit accuses the defendants of fraud, violations of the West Virginia Consumer Credit and Protection Act, malice and/or gross negligence with a reckless disregard for the safety of the resident, breach of fiduciary duty, assisted living facility violations, medical malpractice, and corporate negligence for hiding the problems from the residents’ families and failing to address the issues involved. The administrators and John Doe are also accused of negligence.
