Elderly Woman Tricked Into Smearing Her Own Feces On Her Face At Texas Nursing Home.

When we’re forced to place our elders in nursing homes, we expect that they will be well taken care of. However, as terrible as the truth may seem, nursing home abuse is all too common across the country. Even more alarming, however, is that only one out of every five cases of elder abuse and neglect are actually reported. Victims, or the family of victims, may not know what to do when abuse occurs; that is why such victims should rely on an experienced nursing home abuse personal injury attorney here at the Law Offices of Gilbert R. Hoy, Jr. and Affiliates to help guide them.

An elderly woman’s family is filing a $1 million lawsuit against an Austin, Texas nursing home after video surfaced of a nursing assistant reportedly taunting the woman with a feather as she smeared her own feces on her face. Chandler McCaughan, the son of the 83-year-old woman seen in the video, says that Windsor Nursing and Rehabilitation Services of Duval is at fault for allegedly failing to report the incident to law enforcement and the victims family. The lawsuit also accuses the nursing home of negligently hiring Carlos Santacruz, 23. As a result, the lawsuit alleges more people at the nursing home are at risk of being “abused.”

The lawsuit claims Mr. Santacruz should not have been hired to work at the nursing home in the first place because he has a lengthy arrest record, which includes drug charges, criminal mischief and fraud. Mr. Santacruz was identified as the accused assistant and charged with misdemeanor injury to the elderly by contact. Chandler McCaughan removed his mother from the nursing home after the incident.
